These GTC apply to all business relationships between CYBX DOO (hereinafter 'Provider') and the customer (hereinafter 'Customer') regarding the use of the software 'ProRisk Manager'.
Trading financial products (Forex, CFDs, etc.) involves a high risk to your capital. You can lose more than your initial deposit. The software 'ProRisk Manager' is a tool for risk limitation, but does not guarantee profits and cannot completely rule out losses (e.g., in the case of technical failures, slippage, or market gaps). The Provider assumes no liability for trading losses.
The Customer receives the simple, non-transferable right to use the software for the duration of the contract term on the agreed number of trading accounts. Passing on to third parties or reverse engineering is prohibited.
The Provider warrants that the software works in the sense of the product description. A guarantee for error-free function under all conceivable system configurations cannot be assumed. Liability for slightly negligent breaches of duty is excluded, provided that no essential contractual obligations, damages from injury to life, body or health or guarantees are affected. The Provider is expressly not liable for financial losses resulting from the use of the software (e.g. due to operating errors, software errors or market events).
Subscriptions automatically renew for the selected term unless cancelled. You can cancel anytime in the ProRiskManager dashboard and/or in Whop (your membership/billing portal). Cancellation takes effect at the end of the current billing period. If your plan includes a free trial (available to new customers), you can cancel during the trial to avoid charges.
Usage fees are due in advance. Payment is made via the payment methods offered on the website. If the customer is in default of payment, the Provider is entitled to block access to the software immediately.
Free trials are available to new customers only. If your subscription includes a 14-day free trial, you will not be charged during the trial period. You can cancel anytime during the free trial to avoid charges. After the free trial ends, your selected plan is billed automatically (monthly or yearly) unless you cancel before the trial ends. Since the purchase involves the delivery of digital content not on a tangible medium, the customer expressly agrees that the Provider begins with the execution of the contract before the expiry of the withdrawal period. The customer is aware that by this consent, they lose their right of withdrawal with the start of the execution of the contract.
The law of Serbia applies. The place of jurisdiction is Novi Sad. Should individual provisions of this contract be invalid, the contract remains valid in other respects.
